eNotarization Transforms Legal Processes in the Philippines 

The Supreme Court’s reiteration of the approved eNotarization in 2025 has revolutionized how Filipinos can authenticate documents, allowing individuals and corporations to notarize contracts online through accredited electronic notary services.

Legal Requirements Transcending Outdated Rules 

Traditionally, notarization required physical appearance before a notary public within their territorial commission. 

In 2025, the Supreme Court of the Philippines formally authorized electronic notarization (eNotarization), allowing documents in PDF or PDF/A format to be notarized online through accredited electronic notaries. This reform means Filipinos no longer need to physically appear before a notary public within their territorial commission. 

Instead, appearances can be physical, virtual, or hybrid, and notarized documents are automatically transmitted to the Supreme Court Central Notarial Database. This innovation is part of the judiciary’s digitalization agenda, aimed at making legal processes more accessible, efficient, and secure. 

The practice remains governed by the 2004 Rules on Notarial Practice, which outline requirements for identity verification, record-keeping, and liability. The Supreme Court’s 2025 resolution expanded these rules to cover electronic documents. 

Notaries are still bound by strict standards, but the resolution clarified liability: lawyers cannot be held responsible for misuse of their commission without proof of consent. Territorial jurisdiction has also been modernized—electronic notaries can serve clients nationwide, breaking down geographic barriers. 

How Does eNotarization Work? 

eNotarization is conducted through an Electronic Notarization Facility accredited by the Supreme Court. 

Individuals or corporations upload their documents, create accounts, and undergo identity verification. The electronic notary then notarizes the document digitally, embedding a secure electronic signature and transmitting it to the SC database. 

The system ensures authenticity, prevents tampering, and provides a verifiable trail of notarized documents. The process uses PDF/A standards to guarantee long-term preservation of documents.  

Identity verification can be done through government-issued IDs, biometric checks, or video conferencing. Once notarized, the document carries the same legal weight as a physically notarized paper. 

eNotarization Scenarios: Individual vs. Corporation 

For an ordinary Filipino individual, the eNotarization process is designed to be straightforward. 

  • Imagine you are a tenant preparing a lease agreement. You convert the document into PDF/A format and register with the Supreme Court‑accredited Electronic Notarization Facility. You then schedule a virtual session with the notary, who verifies your identity using your PhilSys National ID or another government‑issued ID. The verification may involve showing your ID on camera, answering security questions, or biometric checks if available. Once confirmed, the notary applies a secure digital signature, and the notarized document is automatically uploaded to the Supreme Court’s Central Notarial Database. Within minutes, you receive a copy that is legally valid nationwide, eliminating the need to travel or wait in queues. 

For a legal corporation/entity, the process is more layered but equally efficient. 

  • Suppose a company needs to notarize a board resolution authorizing a new partnership. The corporate secretary prepares the resolution in PDF/A format and uploads it along with supporting documents such as the SEC registration, Articles of Incorporation, and proof of board authority. Authorized signatories then join a virtual session with the electronic notary. The notary verifies both the entity’s legitimacy and the authority of its representatives, often requiring presentation of corporate IDs and board resolutions granting signing authority. Once verified, the resolution is digitally notarized and stored in the SC database. This process streamlines compliance, especially for corporations with operations across multiple regions, as it eliminates the need for physical coordination and reduces turnaround time from days to hours. 

PH Government Setting the Landscape for Digitalization  

eNotarization sets a precedent for digitizing legal processes, reducing reliance on paper and physical presence. It demonstrates how technology can enhance efficiency, transparency, and accessibility in governance. 

This new upheaval aligns with the Philippines’ extensive digitalization agenda, including eGov services, digital finance, and national ID systems. The judiciary signals its commitment to a digital-first future through the modernization of notaries. 

Moreover, eNotarization is part of a bigger wave of digital transformation initiatives spearheaded by the Philippine government. 

The eGov PH Super App, launched by the Department of Information and Communications Technology (DICT), integrates multiple government services into a single platform, allowing citizens to access NBI clearances, PhilHealth records, Pag‑IBIG contributions, and more from their smartphones. The PhilSys National ID project provides a unified digital identity, enabling secure authentication across government and financial services. 

The Bangko Sentral ng Pilipinas (BSP) has also been at the forefront, introducing interoperable payment systems like QR Ph, InstaPay, and PESONet, which have dramatically increased digital transaction volumes. 

BSP’s Digital Payments Transformation Roadmap aims for 50% of retail payments to be digital by 2027, with 70% of adult Filipinos financially included. Meanwhile, the DICT’s National Broadband Plan seeks to expand internet connectivity nationwide, ensuring that digital services are accessible even in rural areas. 

Collectively, these initiatives spotlight a government‑wide commitment to building a digital‑first economy, where legal, financial, and administrative processes are seamlessly integrated online.
